Terms of Service

These terms govern your use of Formcrest, the form-backend service operated by [Registered business name].
1. Acceptance of terms
These Terms of Service (the “Terms”) are a binding agreement between you and [Registered business name] (“Formcrest”, “we”, “us”, or “our”), a business operated by [Founder full name] and established in Greece (VAT [EU VAT number], registered address [Registered business address, Greece]). By creating an account, accessing, or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.
If you use the service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf, and “you” refers to that organization.
2. The service
Formcrest is a form-backend service. You bring your own HTML form, hosted on your own website; that form submits to an endpoint we provide. We validate the submission, filter spam, store it, and deliver it to one or more destination email addresses you have verified (and, depending on your plan, to webhooks and third-party integrations). We do not provide the form markup, the hosting for your website, or the design of your form — you remain responsible for the content and operation of your own site.
We may add, change, or remove features over time. We will not materially reduce the core functionality of a paid plan during a billing period without notice.
3. Accounts
You must provide accurate, current, and complete information when you register, and keep it up to date. One human may hold one account; automated or bulk account creation is not permitted. You are responsible for all activity under your account and for keeping your credentials secure. Notify us promptly at info@formcrest.com if you believe your account has been compromised.
4. Acceptable use
Your use of the service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Among other things, you must not use Formcrest for phishing or credential harvesting, fraud schemes, spam relaying to inboxes that are not your own, reselling the service as a white-label form backend, or any content that is illegal under EU law or the laws of Greece. Violations may result in suspension or termination as described below and in the policy.
5. Billing, subscriptions & trials
We offer a free plan and paid plans (Pro and Agency), plus optional recurring top-ups for additional destination email addresses. Current plans and prices are listed on our pricing page. Paid plans are billed in advance on a monthly or annual cycle through Stripe, our payment processor.
- Pricing currency. Prices are set in euros (EUR). Stripe Checkout may display your local currency, but the underlying charge is in EUR.
- Taxes. VAT and applicable sales tax are calculated and collected at checkout via Stripe Tax based on your billing country, and reverse-charge VAT is applied for valid EU business VAT IDs. Stripe issues VAT-compliant invoices.
- Pro trial. New accounts may activate a one-time, 14-day trial of Pro features without a credit card. At the end of the trial, the account automatically reverts to the free plan unless you add a payment method. Each account is eligible for one Pro trial.
- Renewals and cancellation. Subscriptions renew automatically until cancelled. You may cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period, and you retain access until then.
- Failed payments. If a payment fails, we may retry it and will email you. If payment cannot be collected, your account is downgraded to the free plan.
Refunds are governed by our Refund Policy.
6. HIPAA — no Protected Health Information
Formcrest is not a HIPAA-compliant service. We do not sign Business Associate Agreements (BAAs). You must not transmit Protected Health Information (PHI) through our forms or store it in our service. Accounts found transmitting PHI may be terminated.
7. PCI — no cardholder data
You must not transmit cardholder data — including full card numbers (PAN), CVV/CVC security codes, or PINs — through forms that submit to Formcrest. We do not store, process, or transmit cardholder data on your behalf, and our forms are not a substitute for a PCI-compliant payment processor. For our own billing we use Stripe, which is certified PCI DSS Level 1.
8. Prohibited content & suspension
We may suspend or terminate your account, and disable or remove forms, if we reasonably believe you have violated these Terms or the Acceptable Use Policy, if required by law, or to protect the service, our other users, or our email-sending reputation. Where we suspend an account or remove content for a policy violation, we will provide a statement of reasons and a path to appeal. Subscriptions for accounts terminated for policy violations are not refunded.
9. Disclaimers & limitation of liability
The service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that submissions or notification emails will always be delivered.
To the maximum extent permitted by law, [Registered business name] will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the greater of the amounts you paid us for the service in the twelve (12) months before the event giving rise to the claim, or one hundred euros (€100). Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Minors (COPPA)
Formcrest is not intended for use by children under 13. Accounts created by users under 13 will be terminated and their data deleted.
11. Sanctions and export
We do not provide service to users, or for use in jurisdictions, subject to comprehensive sanctions imposed by the United States, the European Union, or the United Nations. You represent that you are not located in, and will not use the service in or for, such a jurisdiction, and that you are not subject to such sanctions.
12. Business continuity
If Formcrest is acquired, dissolved, or its operator becomes incapacitated, we will, where reasonably possible, give customers at least 30 days’ notice and the ability to export their data before the service is wound down.
13. Governing law
These Terms are governed by the laws of Greece, without regard to its conflict-of-law rules. Mandatory consumer-protection rights you have under the law of your country of residence are not affected by this clause.
14. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
